4. Games, Leaderboards, and Tournaments

The Service offers HTML5 games, leaderboards, and tournaments. By using these features, you acknowledge and agree that:

Games are provided for entertainment purposes only.
No gambling or real-money wagering. Games do not offer the opportunity to win real money or anything of monetary value by chance, and are not gambling services. Any in-game points, scores, coins, or virtual items have no cash value, cannot be exchanged for money, and exist only within the Service.
Fair play. You agree not to cheat, exploit bugs, use bots, scripts, automation, modified clients, or any other unauthorized means to gain an advantage, inflate scores, or manipulate leaderboards or tournament results.
Score and result integrity. We may verify, adjust, withhold, or remove any score, ranking, or result that we reasonably believe to be inaccurate, fraudulent, or obtained in violation of these Terms, and we may disqualify or ban any User involved.
Tournaments. Specific tournaments may be subject to additional rules, eligibility criteria, entry conditions, schedules, and prize terms presented at the time of the tournament. Those rules form part of these Terms for that tournament. We may modify, suspend, reschedule, or cancel any tournament at any time.
Prizes and rewards. Where prizes or rewards are offered, they are subject to the stated conditions, availability, and applicable law. You are responsible for any taxes arising from prizes you receive.
Leaderboards and tournament participation are provided "as is", and we make no warranty regarding uninterrupted availability, ranking accuracy, or fitness for any particular purpose.

5. Subscriptions, Purchases, and Payments

5.1 Premium Subscriptions

Some features are available only through paid premium subscriptions ("Subscription"). By subscribing, you authorize us (or our payment processor) to charge the applicable fees to your selected payment method.

5.2 Billing and Auto-Renewal

Unless otherwise stated at checkout, Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel. You may cancel at any time through your account settings or by contacting us; cancellation takes effect at the end of the current billing period.

5.3 Pricing and Taxes

All prices are displayed in the currency selected at checkout (e.g., USD or EUR). Prices may change at any time; changes will not affect Subscriptions already paid for the current billing period. You are responsible for any applicable taxes, duties, or currency-conversion fees imposed by your payment provider or jurisdiction.

6. User Conduct

You agree not to:

Use the Service for any unlawful, fraudulent, or harmful purpose;
Upload, post, or transmit content that is illegal, offensive, defamatory, infringing, obscene, harassing, hateful, or that promotes unsafe, self-harm, or dangerous behavior;
Cheat, use bots, scripts, exploits, or any unauthorized means to manipulate games, scores, leaderboards, or tournaments;
Misrepresent your identity or impersonate any person or entity;
Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service;
Probe, scan, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its games;
Use any automated means (bots, scrapers, crawlers) to access, harvest, or extract content or data from the Service except as expressly permitted;
Interfere with, disrupt, overload, or impair the Service or its infrastructure;
Resell, sublicense, redistribute, or commercially exploit the Service or its content without our prior written consent;

7. User-Generated Content

The Service may allow you to submit content, including forum posts, comments, reviews, usernames, profile information, scores submitted to leaderboards, and other materials ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Superplay a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of operating, improving, and promoting the Service.

7.2 Responsibility

You are solely responsible for your User Content and represent that you have all rights necessary to submit it and grant the license above, and that it does not violate any law or third-party right.

7.3 Moderation

We may, but are not obligated to, monitor, moderate, edit, or remove User Content at any time without notice.

8. Intellectual Property

All content provided by Superplay — including text, graphics, logos and brand marks, images, videos, games, recipes, guides, software, and the overall "look and feel" of the Service — is owned by Superplay or its licensors and is protected by copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your personal, non-commercial use only. No other rights are granted, expressly or by implication.

Without limiting the foregoing, we do not warrant that:

News, articles, recipes, fitness content, or other information are accurate, complete, current, or suitable for any particular individual;
Recipes are safe, allergen-free, or appropriate for any specific dietary need;
Fitness or wellness content is safe or appropriate for your physical condition;
Games, leaderboards, and tournaments will be available without interruption, error, or score/ranking inaccuracy;
The Service will be available without interruption, error, or security incident;
Any content will be free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall Superplay, its affiliates, owners, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, health consequences, or any damages arising from:

Your use of, or inability to use, the Service;
Reliance on any content, news, recipe, fitness video, or other material;
Any adverse health, physical, allergic, or medical outcome;
Loss of scores, rankings, virtual items, or tournament results;
Unauthorized access to or alteration of your data or content;
Any third-party conduct or content on the Service.

To the maximum extent permitted by law, the total aggregate liability of Superplay to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid to Superplay in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD 100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the limitations above apply to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Superplay and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any User Content you submit.
